Migrating to Australia

This page contains information about migrating to Australia (as a migrant or refugee), which means travelling to Australia with a visa that gives you the right to live permanently in Australia. If you have any queries regarding migration to Australia and visa issues please contact the migration experts in ABC Migration and Education Centre.

Migration Program
There are two programs designed to help people wanting to come to Australia permanently. One is the migration program which is made up of:

  • GENERAL - ABC has the ability to understand the needs of the client and hence work together with the client to achieve the common goal of a successful visa application.

  • BUSINESS - ABC has strong alliances with some of the most respected organisations in the migration business and is a contact point for industry experts in Australia.

  • SKILLED - ABC offers a complete skilled migration package including the application for skills assessment to the relevant Australian assessing authority.

  • FAMILY - ABC is committed to keeping up with changes to legislation that affects the migration industry especially the family stream.

The migration program for 2002-03 has 100,000 to 110,000 places available for migrants, plus a parent contingency reserve of 4,000 places for a full year.

Humanitarian Program
The second program is the separate humanitarian program which is designed for refugees and others in special humanitarian need.

A major component of the humanitarian program is the offshore resettlement Program, which assists people in humanitarian need overseas for whom resettlement in another country is the only option.

The onshore protection component is for those people already in Australia who arrived on temporary visas or in an unauthorised manner, and who claim Australian protection.

The size of the 2002-03 humanitarian program is 12,000 places.

The complexity of immigration process to Australia can sometimes be quite daunting to many people. The constant changes, amendments and updates of the immigration policies, migration laws and regulations demand a thorough understanding and a sound knowledge of your application procedure.

Many applicants made great efforts and spent a great deal of time and money researching their own prospects of success. To study and research the migration law, migration regulations and policies is definitely not a part time job! It’s time consuming and demands almost full concentration.

Many individuals do apply and succeed eventually on their own merits, while many more that apply on their own encountered many unexpected problems or incurred a lot of additional delays and cost. Many prospective applicants even fail. Our ABC advice is that even if you intend to file an application on your own, you may wish to consult with an immigration consultant before filing any documents. Unless you deal with immigration matters regularly, it is doubtful that you will be able work your way through the process without encountering problems.

Too many a time when applicants brought to us their rejection letters either from DIMIA (Department of Immigration of Multicultural and Indigenous Affairs) or Australian Diplomatic Post Overseas, we find that those rejections were more of the result of ill presentation, rather than ill preparation-a very well prepared application but presented poorly-sounds unreal? But it is true! Sometimes whether the applicant gets a visa or not depends purely on technicalities. We came across two students who arrived in Sydney for only two months. Every part of their conditions were almost identical, born 3 days apart each other, they were formal classmates who studied the same course from the same university, we get the PR visa for one, but his friend who applied on his own did not get it-and there is absolutely nothing we can do about it!

Why is the result so different? Simply because we have advised one to lodge the applications 3 days prior to his 30th birthday, and register for a IELTS test about one month later; while his friend, without any proper advice from anyone, registered for a IELTS test and did the test about 3 weeks after his 30th birthday, with excellent scores, averaging 6.5 in each band, however, due to his application for his PR after he turns 30, he lost his precious 5 points-therefore, he simply does not have enough points to qualify for his visa.

This is a very expensive lesson for him: The points for his age is determined by the time of lodgment of his application, while the language competence is only to be satisfied at the time of decision!!!

Worse still, many prospective immigrants assume that they can get the desired advice from many Australian government agencies or Australian Diplomatic Post Overseas. If this had happened, then few applicants would have failed. But to the disappointment of many, these agencies do not always assume the responsibility for educating prospective immigrants to Australia. They would simply make decisions as to who is to come and who is not, and they should not be blamed because they were doing their jobs!

It is no surprise that many applicants misunderstand the rules and regulations, the process of assessment, due to no fault of their own, but the never-ending process of updating of Migration laws, regulations and policies, which are regularly modified on a weekly basis to meet the objectives of the current Government. An ABC professional consultant can often suggest more options for your situation and provide some kind of solutions to what may otherwise be a problematic case. He then follows it up and communicates with you or those relevant authorities on your behalf to make sure you get your desired visa. No rejections, no appeals etc. Our professional consultant can assist you to assess Australian's system of categories, concessions and accumulation of your candidature. This will definitely save you a lot of time and money.

Please be aware of companies and migration consultants who guarantee a success. Nothing in immigration law can be guaranteed. ABC advocates honest consulting and proper representation, and it never encourages you to misrepresent facts to the government to secure a visa. We will provide you a proper assessment of your chances and inform you accordingly, but we never guarantee a success. We believe honesty is the best policy and this has never fails us. Bound by our Code of Conduct, we believe that to be ethical in our deals and representation with the clients and the relevant government agencies would not jeopardize our clients’ chance of success. On the contrary, in the long run, this should increase the chance of success rate.
